Rustic plot of 25,576m² for sale with 49m² building classed as residential in Villanueva de la Concepción (Málaga).  With the introduction of the new 'LISTA' law regarding as announced by the Junta de Andalucía earlier this month this has now opened up the possibility of building a residential home on land in the countryside whereas previously permission could not be obtained in general, unless the property was needed for a permanent dwelling in conjunction with an economic activity on the land such as farming, agriculture etc.

Located just a few kilometres outside of the nearest town of Villanueva de la Concepción which sits just below the beautiful El Torcal mountain range and 35kms to Antequera and 50kms to Malaga the land is made up of a flat plateau at the entrance where there is a small building (not fit for habitation in its present condition) and tiered sloping levels affording stunning views in all directions.  When the present owners purchased the land more than 20 years ago it was possible back then to build a 250m² Villa with a pool, however the law changed in 2003 and it has not been possible to build on rustic land in Andalucía since, however this is about to change with the introduction of the new territorial law.

Whilst it should also be possible to rebuild the existing structure in it’s current size, with the introduction of the new law it is more likely that a new buyer would wish to demolish this small structure and apply to obtain permission to build a larger house, given the size of the land and the fact that the plot is situated in an area where there are other properties.  Main’s water and electricity utility services are already in the street right up to the plot (but not connected at the plot).  Access is very good by normal car, just a short gravel track from the main road.

The topography of the land is a small flat section where the small dwelling is situated, and further in the land slopes down leading to a second larger flat area at the bottom part of the land.  The views are truly amazing! The local village is in walking distance and the main town of Villanueva de la Concepción is only a few minutes by car.

The land has many almond and olive trees.  The property could also be ideal for keeping horses, as there is good space for stables and paddocks etc.

The property is offered for sale by the owner as seen, which is a rustic plot of land, 25,576m² as listed in the Land Registry of Antequera.  The existing small building on the land was built in 1998 and was adopted as residential by the local town hall for council tax rates etc.  The location where the land is situated also has other residential properties and the town hall includes both parts of the property, (the dwelling and the land) on their Catastro Register, with the dwelling being classified as Residential (ie., URBAN).  but the land remains classified as RUSTIC.  Local Council Taxes (IBI) are payable annually for both elements accordingly although these will be very low on this property.  In recent times the Town Halls in rural areas have updated their Catastros and combined the elements into a new single Catastro Reference.
